What is the Move Over Law?

In Virginia, the Move Over law was enacted in 2002 and requires drivers to move over one lane in the event that they pass vehicles that are flashing red, blue, or amber lights. This can include lights from a towing company, police department, or fire department. 

The Move Over law was specifically enacted to protect operators and drivers of a towing company and other road maintenance, emergency vehicles, and Virginia Department of Transportation (VDOT) vehicles.

What are the rules?

In order to protect yourself and others on the road, it is extremely important to follow the rules of the Move Over law. 

When you see a blue, amber, or red flashing light, make sure that you drive with caution and move over to a lane that is not adjacent to the stationary vehicle. 

If you are unable to change lanes due to the fact that it is unsafe or not possible, make sure to drive at a safe speed and proceed with caution. This law only applies on highways that have 4 or more lanes.

Are there penalties if I don't follow the Move Over law?

For a first violation, you will be punished with a traffic infraction. If you continue to disregard the Move Over law, you will be punished with a Class 1 misdemeanor. Conviction of a Class 1 misdemeanor can include jail time of up to 12 months and/or a fine of up to $2,500.00.

If you do not follow the Move Over law and there is damage to property, you may have your license suspended for up to a year. If there is injury or death related to you not obeying the Move Over law, you may lose your license for up to two years.
